When you contribute image content, such as radiology cases including but not limited to X-rays, CT, MRI, ultrasound, angiography, images, diagrams, and photos (but not text content), to any platform, you are giving Osteosynthesis.org a license to use it under the Creative Commons Attribution-Noncommercial-Share Alike 3.0 Unported license (CC License).

Text content

In order for text content you contribute to Osteosynthesis.org to be easily accessed by other Osteosynthesis.org users, all rights to the text content you contribute to any platform, including but not limited to articles, case and image descriptions, multiple-choice questions, blog posts, playlists, tutorials, and all communications you transmit to anyone through any platform (Text Content), become the property of Osteosynthesis.org and you assign to Osteosynthesis.org, without charge and effective upon contribution, all right, title, and interest in the content (including any copyright, but excluding any non-assignable personal rights). Unless otherwise agreed upon by Osteosynthesis.org in writing, all such content is also licensed to you under the Creative Commons Attribution-Noncommercial-Share Alike 3.0 Unported license. You may modify Text Content in good faith and for legitimate use on a platform, but you may not otherwise modify, copy, distribute, reuse, reproduce, republish, download, display, post, transmit, or sell Text Content in any form or by any means, in whole or in part, outside the scope of this license, without written permission from Osteosynthesis.org.

Warranty

For all content, including Image Content and Text Content, that you contribute to any platform (Your Content), you warrant that you have the right to contribute this content to the platforms and to allow it to be used in accordance with these terms of use. You also warrant that the content:

  • Was collected by you in a diligent and professional manner and in accordance with the Privacy Act 1988 (Cth)
  • Is de-identified such that the identity of each patient related to Your Content is not identifiable or reasonably identifiable
  • Comprises legitimate and original content, such as but not limited to radiographic images (CT, US, MRI, X-rays, DSA, etc.), photos, diagrams, and illustrations, and that these have not been copied from any secondary source
  • Will not infringe any third party intellectual property rights when used on or in connection with any platform

Moral rights etc

You agree that Osteosynthesis.org and third parties can use Your Content in any way that would normally infringe on any personal rights that you may have in Your Content, even if the Creative Commons License or other laws say otherwise.

Modifications to CC Licence

If you contribute content, including Image Content and Text Content, to any platform (Your Content), you acknowledge that the platform is a "Collection" as defined in the Creative Commons Attribution-Noncommercial-Share Alike 3.0 Unported license (CC License). You also acknowledge that the CC License is amended as follows in regards to Your Content (regardless of when you posted it):

  • Osteosynthesis.org will try to ensure appropriate attribution is made or not made (as needed), but will not be responsible in any way for failing to make appropriate attribution or failing to follow any request to remove attribution.
  • Osteosynthesis.org may:
    • Accept commercial sponsorship
    • Charge users for registering for, accessing, or using any platform (except the web platform, which will always be free to access) and/or for access to certain modules of Image Content and Text Content on any platform (except the web platform)
    • Sub-license its rights under these terms of use to Osteosynthesis.org Events for use by that company for providing commercial and non-commercial educational and training services and related events
  • If the CC License is terminated for any reason, Osteosynthesis.org will try to comply with any written request from you to remove any content you contributed, but is not required to do so. You also agree that Osteosynthesis.org's license under these terms of use is perpetual and irrevocable and that damages are your sole remedy for any breach of the license.

  • If Osteosynthesis.org wishes to use or receives a request to use Your Content outside the bounds of the license rights granted under these terms of use, you will not unreasonably withhold your consent to such use. If Osteosynthesis.org, after using reasonable efforts to contact you to seek consent, is unable to contact you, Osteosynthesis.org may make a decision on your behalf at its discretion. If you consent or are deemed to have consented to such use, you appoint Osteosynthesis.org to act on your behalf and make decisions regarding any dealings with third parties in relation to such use, including doing all necessary things and executing all necessary documents (whether in the form of a deed or an agreement or otherwise) to enable such use.

Fair Use of Content

Osteosynthesis.org is not intended to be used as a data set for machine learning or artificial intelligence research, nor can it be bulk downloaded using an automated script or robot. Similarly, the "Download all Images" feature is only intended for downloading cases for teaching, presentations, or personal study. Downloading a large number of cases with hundreds of images using this feature is not allowed.

We reserve the right to block unauthorized automated access and take other necessary measures to protect the intellectual property rights of user-contributed content and the stable operation of the website. Platform Intellectual Property Rights

Osteosynthesis.org owns all rights to the software, designs, arrangements, and graphics on the platforms. All trademarks, product names, company names, and logos displayed on the platforms are either trademarks or registered trademarks of Osteosynthesis.org or its associates, and cannot be reproduced, imitated, or used without permission. Page headers, custom graphics, button icons, and logos are service marks, trademarks, and/or trade dress of Osteosynthesis.org or its associates, and cannot be reproduced, imitated, or used without permission.

User Conduct - General

In using any platform from Osteosynthesis.org, you agree:

  • To follow all policies from Osteosynthesis.org or its associates on the platform or as communicated to you by them

We may also collect information about how you interact with the Platforms, such as the number of cases you upload, edit, or contribute, and link this information to your account.

IP Address

Your computer has a unique identification number called an Internet Protocol (IP) address when it's connected to the internet. When you access our services through any platform, our servers need to know your IP address, which is sent automatically when you request information (e.g. a web page showing a particular patient case on the Osteosynthesis.org website).

If you are logged in to any platform, we may link your IP address to your login. When you are not logged in, we do log your IP address, but we do not automatically link it to any information that would allow us to identify you. However, if it becomes necessary to enforce our terms of use or protect our platforms, other users, or third parties (e.g. patients), we may try to use the logged IP address with other information to try to identify you. We also use IP addresses to determine the approximate location of the device you used to access our platforms.

Usage Data

Usage Data includes information about how you interact with the web pages and websites on the Platforms. This is collected using cookies or similar technologies placed by us and others. Anonymity of cases/images

It is required by our terms of use that all patient cases uploaded to any of our platforms by users are de-identified, meaning that the identity of the patients referred to in the case (e.g. medical images and notes) is not identifiable. This applies to all images uploaded to any platform, including but not limited to cases (public, unlisted, or draft), slides, diagrams, and blog posts. If you believe that you or someone else can be identified from a case on our platforms, please contact us at privacy@osteosynthesis.org immediately.

There is certain information that should not appear on any patient cases uploaded to our platforms, based on HIPAA guidelines. This includes but is not limited to:

  • Name
  • Initials
  • Date of birth
  • Address (full or partial postal code)
  • Phone numbers or contact information
  • Email addresses
  • Unique identifying numbers (e.g. UR, MRN, HID, etc.)
  • Vehicle identifiers
  • Medical device identifiers (e.g. serial numbers)
  • Web or internet protocol addresses containing any link to the patient
  • Biometric data
  • Facial photographs or similar images
  • Names of relatives
  • Date of the study

Additionally, if a case is unique in a way that could lead to the identification of an individual from the images alone, it should not be uploaded. This means that cases that have received media attention or show rare symptoms are usually not appropriate for upload. The text accompanying the images should also not contain identifying information or unnecessary details that could help identify a patient.

Please note that our privacy policy does not override the policies of institutions, and users should ensure that they are using images within their local guidelines. We take patient privacy very seriously, and failing to follow these rules is a breach of our privacy policy and terms of use. If you upload a case with patient information or that could reasonably be used to identify the identity of a patient, it will be edited to deleted by an administrator without warning.

Our commitment to data security

We have implemented security measures to protect the personal information we collect online. These measures include physical, electronic, and managerial procedures to prevent unauthorized access, maintain data accuracy, and ensure the correct use of information.

Online tracking by Us and Third Parties

We do not alter our data collection practices based on the Do Not Track setting in your web browser. This setting will not prevent us from collecting Usage Data or allowing other providers to do so.

Cookies, Your say and How to 'Opt-out'

You can ask us to let you see any personal information we have about you, like your User Information. We will try to answer your request as soon as possible, and within 30 days if you are in the European Union. We will usually let you see this information, unless there are certain reasons why we cannot. You can also ask us to fix any mistakes in your personal information that we have. You can also terminate your account at any time by sending an email requesting termination to info@osteosynthesis.org, and Osteosynthesis.org will promptly implement your request. If your account is terminated, Osteosynthesis.org may delete any content related to your use of the platform. You will no longer be able to use any registration features on the platform after your account is terminated. You can continue to browse content on the web platform, but your continued browsing will be considered acceptance of these terms of use.

Applicable Law

These Terms of Use shall be governed by the laws of the State of New South Wales, Australia.

Competent Jurisdiction

In the absence of mutual agreement, any dispute arising from the interpretation and/or performance of the present Terms of Use shall be submitted to the exclusive jurisdiction of the competent Courts of the State of New South Wales, Australia.

Effective Date, Amendment and Severability

These terms of use became effective on 01.01.2021 (last updated 26.12.2022). Osteosynthesis.org may update these terms of use (including the privacy policy) by posting the changes online.
